Terms of Service

1. Description of the Service
ClassGear is a free web application that allows educators, coaches, and group organizers ("list creators") to build shareable supply and equipment lists with links to products at third-party retailers. Parents, students, and other visitors ("list viewers") can view published lists and click through to purchase products at those retailers.
2. Eligibility
You must be at least 13 years of age to use ClassGear. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. ClassGear is not directed at children under 13 and we do not knowingly collect personal information from children under 13.
3. Accounts and Authentication
Anonymous use
You may create and edit a supply list without creating an account. An anonymous session is maintained via a short-lived cookie linked to your draft list. Anonymous drafts that are not claimed within 90 days may be deleted.
Email authentication
To save lists to a persistent account, access your lists across devices, or invite co-editors, you must verify your email address. We use a one-time passcode (OTP) sent to the email address you provide. You are responsible for ensuring your email address is accurate and for keeping your session secure.
Account responsibility
You are responsible for all activity that occurs under your account. Notify us immediately at support@classgear.co if you believe your account has been compromised.
4. User Content
Your content
You retain ownership of the supply lists, item titles, descriptions, notes, and other content you create on ClassGear ("User Content"). By submitting User Content, you grant ClassGear a non-exclusive, worldwide, royalty-free license to store, display, and distribute that content as necessary to operate the Service.
Acceptable use
You agree not to submit User Content that:
- Is false, misleading, or deceptive
- Infringes any third-party intellectual property rights
- Contains spam, unsolicited commercial messages, or malicious links
- Violates any applicable law or regulation
Published lists
When you publish a list, it becomes publicly accessible at its unique URL. You control whether your list is published or unpublished at any time from the list editor. Unpublished lists are not visible to the public.
Co-editors
You may invite other verified users to co-edit your list. Co-editors can add, edit, and reorder items but cannot delete the list, remove other co-editors, or transfer ownership. You (the list owner) may remove co-editors at any time.
5. Affiliate Links and Pricing
How affiliate links work
ClassGear participates in affiliate programs including the Amazon Associates Program and may participate in programs with other retailers. When you add a product URL to your list, ClassGear may append an affiliate tracking tag to that URL. When a list viewer clicks a product link and makes a purchase, ClassGear may earn a referral commission from the retailer.
No price impact
Affiliate tags do not change the price paid by the consumer. The cost to list viewers is identical to what they would pay visiting the retailer directly.
Price accuracy
Product prices displayed on ClassGear are fetched at the time a product is added and are shown for reference only. Actual prices at the time of purchase may differ. ClassGear makes no warranty regarding the accuracy of displayed prices.
Amazon Associates disclosure
ClassGear is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. Our associate tag is classgear-website06-20.
6. Third-Party Links and Content
ClassGear displays product information, images, and links sourced from third-party retailers including Amazon, Target, Walmart, and others. ClassGear does not control, endorse, or assume responsibility for:
- The availability, accuracy, or quality of third-party products
- The practices of third-party retailers
- Any transactions between list viewers and third-party retailers
Your purchase from a third-party retailer is governed entirely by that retailer's terms of service and policies.
7. Intellectual Property
The ClassGear name, logo, interface design, and underlying software are owned by ClassGear and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Scrape, crawl, or systematically extract data from the Service without written permission
- Submit content containing malware, phishing links, or scripts designed to harm users
- Impersonate any person or organization
- Use the Service to send unsolicited communications to other users
9. Termination
We reserve the right to suspend or terminate your account or access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, ClassGear, or third parties.
You may delete your account at any time by contacting support@classgear.co. Upon deletion, your lists will be unpublished and your personal data will be handled in accordance with our Privacy Policy.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLASSGEAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
12. Indemnification
You agree to indemnify and hold harmless ClassGear and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your User Content, your use of the Service, or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
14. Changes to These Terms
We may update these Terms from time to time. We will indicate the effective date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
